We write in response to your telephone message of October 2, 2002 at 11:53 a.m. to Andrew Wilson of this office. In that message,c you stated that “I am calling about service. I haven’t heard from you. I haven’t received any documents yet, so I wanted to find out if you were intending to serve me or what the status is.”
Despite these statements, we are confident that service was performed properly in Canada on July 8, 2002 by the sheriff in compliance with the Hague Convention on international service. Enclosed please find a copy of the Proof of Service filed with the Court.
Nevertheless, after receiving your letter of September 2, 2002 stating that you had not received these documents, out of an abundance of caution, we sent you, by Federal Express delivery at the Germany address provided by you, an additional copy of all of the documents previously served in Canada. Enclosed please find a copy of the Federal Express delivery confirmation establishing that the package was signed for on September 27, 2002.
Therefore, your statements are not supported by the facts. The enclosed documentary evidence confirms that service has been accomplished. Accordingly, please arrange to file a responsive pleading as soon as possible or, we will have no alternative but to proceed to take your default and obtain a judgment in due course.
